Terms of Service

1. Acceptance of Terms

By accessing or using Dally ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Escape Velocity Ventures ("we", "our", or "us").

2. Description of Service

Dally is a content intelligence platform that allows Instagram creators to connect their accounts, analyze their content performance using private metrics, and optionally participate in a cross-creator content discovery network. The Service includes AI analysis of your content, performance benchmarking, and content search features.

3. Account Registration

You must create an account using Google Sign-In to use the Service. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. By connecting your Instagram account, you authorize us to access your content and insights data as described in our Privacy Policy.

4. Data and Content

You retain all ownership rights to your Instagram content. By connecting your account to Dally, you grant us a limited, non-exclusive license to:

• Store and process your content metadata and performance metrics for the purpose of providing the Service
• If you opt in: display your content in the Dally discovery network for other creators to browse
• Generate AI analysis and insights based on your content data
• Include your anonymized metrics in aggregate benchmarks (only with your opt-in consent)

You can revoke this license at any time by disconnecting your Instagram account and requesting data deletion.

5. Network Participation

The Dally discovery network is opt-in. By enabling sharing controls, you agree that other Dally users may view your content metadata, thumbnails, and performance metrics. You may disable sharing at any time, and your data will be removed from the network within 24 hours.

6. Acceptable Use

You agree not to:

• Use the Service to scrape, harvest, or collect data about other creators without their consent
• Attempt to reverse-engineer the Service or access data you are not authorized to view
• Use the Service in violation of Instagram's Terms of Use or Meta's Platform Terms
• Share access to your account with unauthorized third parties

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice before any significant changes that affect your data.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

You may terminate your account at any time by disconnecting your Instagram account and requesting data deletion. We may terminate or suspend your access for violation of these terms. Upon termination, we will delete or anonymize your data within 30 days.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance.
